1. Acceptance of Terms

By accessing, browsing, or utilizing the services provided by thishere.com (hereinafter referred to as "the Service," "we," "us," or "our"), you (hereinafter referred to as "User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service (hereinafter referred to as "Terms," "Agreement," or "TOS"), including any additional terms, conditions, and policies referenced herein or available by hyperlink. These Terms constitute a legally binding agreement between you and thishere.com.

2. Description of Service

thishere.com provides a stateless URL encoding service that compresses and encodes Uniform Resource Locators (URLs) using client-side compression algorithms. The Service operates without server-side data storage; all URL information is encoded directly within the generated link. The Service is provided "as is" and "as available" without warranties of any kind.

3. Prohibited Uses

You expressly agree that you shall not use the Service for any purpose that is unlawful, illegal, or prohibited by these Terms. You are strictly prohibited from using the Service to encode, distribute, share, or facilitate access to any content, material, or activity that violates:

  • Any law, statute, ordinance, regulation, or legal requirement of the United States of America, including but not limited to federal, state, and local laws;
  • Any law, statute, ordinance, regulation, or legal requirement of the country, state, province, territory, or jurisdiction in which you reside, are located, or from which you access the Service;
  • Any international law, treaty, or convention applicable to your use of the Service;
  • Any law, statute, ordinance, regulation, or legal requirement of any jurisdiction to which the content or URLs you encode may be directed, accessed, or distributed.

This prohibition applies to all illegal activities without limitation, regardless of whether such activities are specifically enumerated herein. You bear sole responsibility for ensuring that your use of the Service complies with all applicable laws in all relevant jurisdictions. Ignorance of the law shall not constitute a defense to any violation of these Terms.

We reserve the right, in our sole discretion, to determine what constitutes a violation of these Terms and to take appropriate action, including but not limited to blocking access to the Service, without prior notice or liability.

4. User Responsibilities

You are solely responsible for all URLs you encode using the Service and for all consequences arising from such use. You represent and warrant that: (a) you have the legal right to use and share any URLs you encode; (b) your use of the Service will comply with all applicable laws and regulations; (c) you will not use the Service in any manner that could harm minors; and (d) you are at least eighteen (18) years of age or the age of majority in your jurisdiction.

5. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THISHERE.COM, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND ANY THIRD-PARTY INFORMATION PROVIDERS (COLLECTIVELY, THE "INDEMNIFIED PARTIES") FROM AND AGAINST ALL CLAIMS, LOSSES, EXPENSES, DAMAGES, COSTS, AND LIABILITIES, INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEYS' FEES AND COURT COSTS, ARISING OUT OF OR RELATING TO:

  • Your use or misuse of the Service;
  • Any URLs you encode, share, or distribute using the Service;
  • Your violation of these Terms;
  • Your violation of any applicable law, regulation, or third-party right, including without limitation any intellectual property, privacy, or proprietary rights;
  • Any claim that your use of the Service caused damage to a third party;
  • Any content accessed through URLs you have encoded using the Service;
  • Any disputes between you and any third party relating to your use of the Service.

This indemnification obligation shall survive the termination of these Terms and your use of the Service. The Indemnified Parties reserve the right, at their own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with the Indemnified Parties in asserting any available defenses.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. THISHERE.COM DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THISHERE.COM, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THISHERE.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THISHERE.COM EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. You irrevocably consent to the exclusive jurisdiction and venue of the federal and state courts located within the United States for all disputes arising out of or relating to these Terms or the Service.

9. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.

10. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by thishere.com, constitute the entire agreement between you and thishere.com concerning the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and thishere.com with respect to the Service.

11. Modifications to Terms

We reserve the right, in our sole discretion, to modify, amend, or update these Terms at any time. Any changes will be effective immediately upon posting of the revised Terms on the Service. Your continued use of the Service following the posting of changes constitutes your binding acceptance of such changes. It is your responsibility to review these Terms periodically for updates.
